1. Introduction
By using Creator, you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use the platform.
2. Agreement to Terms
This Agreement takes effect on the date on which you first use the Creator application or create an account, whichever comes first. By continuing to use the platform, you acknowledge that you have accepted these terms.
3. Software License
Creator grants you a non-exclusive, non-transferable license to access and use the software for your personal or business purposes. The license is perpetual for one-time purchases and active for the duration of your subscription for recurring plans. We reserve the right to terminate or suspend your license if you violate these terms.
4. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials. Any activity that occurs under your account is your responsibility. You agree to notify us immediately of any unauthorized use of your account.
5. Refunds
Due to the nature of digital products and services, refunds are handled on a case-by-case basis. Subscription plans may be canceled at any time, and you will retain access until the end of your current billing period. For one-time purchases, please contact hello@getcreator.dev within 14 days of purchase if you are unsatisfied.
6. Disclaimer
Creator is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, secure, or error-free. We are not responsible for any loss of data or damages resulting from your use of the platform.
7. Limitation of Liability
To the maximum extent permitted by law, Creator and its creators shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the platform. Our total liability shall not exceed the amount you have paid for the service in the 12 months preceding the claim.
8. User Content
You retain ownership of any content you create or upload to the platform. However, you grant us a limited license to store and process your content as necessary to provide the service. We are not responsible for user-generated content or how you choose to use the platform.
9. Price Changes
Creator reserves the right to modify pricing at any time. Existing subscribers will be notified of any price changes at least 30 days in advance. Early adopters who purchase at introductory pricing will be honored at their original rate for the duration of their active subscription.
10. Governing Law
These terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these terms or your use of the platform shall be resolved through binding arbitration or in the courts of the applicable jurisdiction. No partnership, employment, or agency relationship is created between you and the platform.
